Lawyers of ace broadcaster Kwasi Kyei Darkwah have averred that the 19-year-old complainant in the ‘KKD rape saga’ – Awuraffe Orleans Thompson – was all over the fashion icon in a romantic way in the lobby of the African Regent hotel before the alleged rape took place.
A motion on notice filed by KKD’s Lawyers on Wednesday December 31, 2014, said: “The complainant was captured by CCTV footage in the hotel romantically kissing the accused person before the alleged non-consensual sexual incident, and most importantly, after the alleged rape was said to have occurred, the footage shows the accused and the complainant walking together from the hotel suite and through the hotel lobby in much the same manner as they entered the hotel suite.”
The motion said per that evidence coupled with others, the sexual intercourse between the CEO of the Finest Productions and father of two cannot be said to have been rape.
“There is nothing in the facts to show that the accused had sex with the complainant without her consent,” the motion application said.
KKD’s Lawyers are attempting to secure bail for the beleaguered fashion icon who has been in detention at the Airport Police Command in Accra since Saturday night after his arrest.
The Lawyers also wondered in their application filed at the Human Rights Court on Wednesday December 31, 2014, how come neither KKD’s cousin nor the alleged victim’s cousin, who were both in the same hotel room, heard any noises of protest from the 19-year-old girl during the alleged rape.
“…Even though the said two persons remained in the room during the act, the facts do not state that anyone of them heard a noise from the so called victim in a show of disapproval of the alleged sex that took place,” the Lawyers argued in the motion.
KKD is billed to reappear before the District Magistrate Court on January 8, 2014 after he was denied bail Tuesday December 30, 2014.
He has been in the custody of the Airport Police since his arrest on Saturday.
