An attempt by counsel of hip-life artiste, Emmanuel Botchwey aka ‘Abodam’, to get a Kumasi High Court to grant the musician bail because of medical reasons hit a snag when the lawyers could not produce a medical report to back their claim.
Meanwhile a forensic report has confirmed that the substance Abodam was allegedly smoking in public at the time of his arrest was Indian Hemp also known as marijuana.
The music icon, remanded to two weeks in prison by the KMA Circuit Court on Monday, had filed a motion at the High Court to be granted bail.
Abodam’s lawyer, Nana Kwasi Boaitey, argued that his client was not in good health therefore the need for him to be granted bail to seek proper medical care.
He also stressed that his client, a popular musician in the country, would not bolt if the court grants him his bail application.
Lawyer Akwasi Boaitey noted that his client was ready for any requirement in terms of surety by the court to grant Abodam bail.
The presiding judge, Justice Edward K.B. Apenkwa, giving his ruling, said narcotic offences don’t merit bail.
He added that even though he as the judge was prepared to tamper justice with mercy and grant the musician bail on health grounds, the lawyer’s refusal to produce a medical report in court to support his argument wouldn’t permit him to grant the bail.
Kwaw Kesse had been on remand for the past two weeks for allegedly smoking a substance suspected to be cannabis.
He was reportedly rushed to the hospital a few days ago due to deteriorating health.
